It is an essential pre-condition to you using our website that you agree and accept that ExampleSquare.com is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website. COMPETITION AND CONSUMER ACT

For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), ExampleSquare.com’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.

You must be over 18 years of age to use this website and to purchase any goods or services. If you are below the age of 18 years, we will require proof of parental or guardian consent. You will need to have your parent or guardian agree to these terms and make any purchase on your behalf. At no time will we knowingly accept any personal details or information from anyone under the age of 18 years so we ask that you refrain from providing your personal detail if you are under 18 years of age.

DELIVERY OF GOODS

Physical goods may be delivered by Australia Post and/or other reputable courier companies. Deliveries are processed promptly upon receipt of full payment. Delivery may take between 2 and 14 days, depending on the delivery option. Damaged or lost orders should be resolved with Australia Post or the courier company directly and we are not responsible for goods that are damaged in transit or not received. Replacement of damaged or lost items is made at the discretion of ExampleSquare.com.

Digital goods are delivered immediately. Please be aware there are inherent risks associated with downloading any software and digital goods. Should you have any technical problems downloading any of our goods, please contact us so we may try to assist you.

RETURNS AND REFUNDS

ExampleSquare.com handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.

Should you wish to request a refund of our Program, please notify us within 7 days of access of your Program and include with a reason in writing for request.

For any other issue or refund request, if we are unable to resolve your complaint or further assist you, we will process a refund by the same method you made your original payment. Some banks take longer to process the refund so please allow up to 72 hrs to receive your refund once we have advised that it has been processed. All refunds are made at the discretion of ExampleSquare.com.

PROGRAM ACCOUNT ACCESS

To be eligible to access our educational online programs (‘Programs’) and website services, you need to set up an account and make prior payment for any Program. Prices may change from time to time as indicated on our website but the price for any student participant in our Program stays the same for the duration of the Program. In order to access our Program and take part in our services, you acknowledge and agree to the following:

• You will not share your password or login details with any other person;

• If you become aware of any unusual activity or believe someone has accessed your account, you need to notify us immediately so we may cancel the account and re-issue you with access to the Program;

• You warrant that all information you provide is true, correct, up-to-date and accurate personal information and details;

• We, at all times, abide by the Australian Privacy legislation. Please refer to our full Privacy Policy on our website for details of how we collect, store and use your personal information; and

• Our Programs are only available for a limited period. Please refer to our individual Program information on our website for confirmation of any access periods;

You further agree and warrant that:

• You will not transfer, sublicense or grant access to any of our Programs or services to any other person, company, business except as agreed in these Terms;

• You have all necessary intellectual property rights in and to all postings you provide and all material they contain;

• Your posts shall not infringe any proprietary or other rights of third parties including but not limited to copyright;

JURISDICTION
